§ 1. Operator and scope of the Regulations
1. The operator of the fishery premises and fishing spots is Siedliska11 Sp. z o.o., address: Siedliska 91, NIP (Polish Tax Identification Number): 88123456789, Operator telephone: +48 888 999 111 (available during the fishery opening hours; in an immediate emergency call 112), e-mail: info@siedliska11.pl, hereinafter referred to as the “Operator”.
2. These Regulations set out the rules for:
a) using the fishery premises,
b) using fishing stands, piers, access routes and associated infrastructure,
c) maintaining safety near the water,
d) recreational angling,
e) conduct in an emergency or accident.
3. These Regulations apply to all persons present on the fishery premises, regardless of whether they are angling.
4. Purchasing a ticket, making a reservation, signing an entry form or commencing use of the fishery after the Regulations have been made available constitutes acceptance of the Regulations.
5. The Regulations are available:
a) at the entrance to the fishery premises,
b) at the ticket sales point,
c) on the Operator’s website or in the Operator’s booking system,
d) at the User’s request in a form that allows the Regulations to be saved.
§ 2. Nature of the premises and basic hazards
1. The fishery is a recreational area intended primarily for angling from designated fishing stands.
2. The fishery premises are not a designated bathing area or a place occasionally used for bathing.
3. No permanent lifeguard supervision is provided at the fishery unless the Operator expressly states otherwise.
4. Staying near the water entails inherent risks, including in particular:
a) drowning,
b) slipping or falling,
c) sudden changes in depth,
d) unstable or waterlogged ground,
e) steep or slippery banks,
f) currents and whirlpools,
g) changes in water level,
h) high water, flooding or inundation,
i) falling branches and falling trees,
j) thunderstorms, strong wind, ice, fog or reduced visibility,
k) injury caused by fishing equipment or a hook,
l) electric shock, in particular during a thunderstorm or near overhead power lines.
5. The User must exercise particular caution, comply with signs and the Operator’s instructions, and use only the areas made available.
6. Information about inherent hazards does not limit the Operator’s liability arising under mandatory provisions of law.
§ 3. Rules of entry and use of the fishery
1. The fishery may be used only:
a) during its opening hours,
b) after payment of the required fee or completion of a reservation,
c) at a stand allocated or indicated by the Operator,
d) in accordance with signs and safety notices.
2. The User should hold the documents and fishing entitlements required by law, by the permit issued by the entity entitled to conduct fisheries management, or by the rules applicable to the relevant fishing district.
3. A ticket or reservation does not replace a Polish angling card (karta wędkarska), fishing permit or any other document where possession of such a document is required.
4. The User must provide the Operator with accurate information necessary to make the reservation, identify the User and provide assistance in an emergency.
5. The Operator may refuse entry or order a person to leave the premises if that person:
a) is under the influence of alcohol, drugs, intoxicating substances or medication impairing safe conduct,
b) behaves aggressively or dangerously,
c) refuses to comply with the Regulations,
d) poses a risk to themselves or other persons,
e) attempts to enter a closed area or an area excluded from use.
6. The Operator’s safety instructions must be followed immediately.
§ 4. Strict prohibitions
1. The following are strictly prohibited on the fishery premises:
a) bathing, swimming or immersing oneself in the water,
b) jumping into the water,
c) entering the water to land a fish, recover equipment or for any other reason,
d) using boats, pontoons, kayaks, air mattresses, boards or any other watercraft without the Operator’s separate written consent,
e) consuming alcohol or using intoxicating substances,
f) using a fishing stand after consuming alcohol or intoxicating substances,
g) running, pushing or making sudden movements on piers or near the bank,
h) sitting, standing or walking on railings,
i) leaning beyond the edge of a pier in a manner that creates a risk of falling,
j) moving, removing or modifying railings, piers, signs, ropes, lifebuoys or other equipment without authorisation,
k) using a stand marked as closed, damaged or out of service,
l) entering slopes, banks or areas not designated for use,
m) lighting a fire outside places expressly designated by the Operator,
n) leaving rods, hooks, fishing lines or other objects in a manner that endangers other persons,
o) casting towards people, animals, roads, buildings, cables or electrical equipment,
p) angling beneath overhead power lines or within a marked safety zone,
q) using fishing rods during a thunderstorm, electrical discharges or in the immediate vicinity of power lines,
r) leaving children without the direct supervision of an adult,
s) damaging vegetation, banks, reinforcements or infrastructure,
t) leaving waste, fishing lines, hooks or groundbait outside designated places.
2. The prohibition on bathing also applies in hot weather, following the loss of equipment, where a fishing line becomes snagged or where a fish needs to be released.
3. A person who breaches the prohibitions may be removed from the fishery premises immediately if their continued presence creates a safety risk.
§ 5. Fishing stands
1. The User may use only the stand allocated or indicated to them.
2. Creating stands independently, cutting vegetation, constructing steps, reinforcements or platforms, or interfering with the shoreline is prohibited.
3. Before starting to use a stand, the User should carry out a basic visual inspection and immediately report to the Operator any:
a) damage to a pier or railing,
b) slippery surface,
c) ground subsidence,
d) fallen tree or overhanging branches,
e) missing rescue equipment,
f) other hazard.
4. The User’s visual inspection of the stand does not release the Operator from the obligation to properly maintain and inspect the infrastructure.
5. The User may not use the stand until the reported hazard has been inspected.
6. A maximum of 3 anglers and the number of accompanying persons accepted in the reservation may be present at one stand at the same time, subject to the permitted load and the conditions of the particular stand.
7. The maximum total load of a pier, including persons, equipment and other items, is 350 kg. This limit must not be exceeded, regardless of the number of persons on the pier.
8. Equipment, chairs, fishing shelters and other items must be positioned so that they:
a) do not obstruct an evacuation route,
b) do not impede access to rescue equipment,
c) do not create a tripping hazard,
d) do not place a load on railings or the edges of a pier.
9. Leaving cast fishing rods unattended is prohibited.
§ 6. Minors and persons requiring assistance
1. A minor may be present on the fishery premises only under the continuous, direct and effective supervision of an adult guardian.
2. The guardian is personally responsible for supervising the minor throughout the minor’s entire stay on the fishery premises.
3. Watching a child from a distance that prevents an immediate response does not constitute direct supervision.
4. A minor may not independently:
a) remain on a pier or directly at the water’s edge,
b) use rescue equipment, except in an emergency,
c) light a fire,
d) move around the premises after dark.
5. A minor present on a pier, at a stand without a railing, on a steep bank or in another location designated by the Operator must wear a properly fitted buoyancy aid or life jacket appropriate to their body weight.
6. The Operator may also require an adult to wear a life jacket where this is justified by the conditions of the stand, the weather, the water level or a particular hazard.
7. A person with mobility, balance or orientation problems, a tendency to faint, or any other limitation that may increase the risk of falling into the water should use the fishery in the company of a person capable of providing assistance.
§ 7. Weather and hydrological conditions
1. The Operator may immediately:
a) close the entire fishery,
b) close an individual stand,
c) order angling to stop,
d) order persons to leave a pier or the premises, where a threat to life, health or property has occurred or may occur.
2. Reasons for closure may include in particular:
a) a thunderstorm or the possibility of electrical discharges,
b) strong wind,
c) heavy rainfall,
d) a river rise or an increase in water level,
e) a flood risk,
f) damage to a bank, pier or tree,
g) ice,
h) reduced visibility,
i) water contamination,
j) technical or rescue work.
3. After hearing thunder, seeing lightning or receiving an instruction from the Operator, the User must:
a) stop angling immediately,
b) take down the fishing rods,
c) move away from the water, piers, tall trees and power lines,
d) go to the designated safe location.
4. The User may not return to the stand until the Operator has declared the hazard over.
5. If the fishery is closed for safety reasons, settlement for the unused part of the service is governed by the booking conditions. The consumer’s rights arising under applicable law are not limited.
§ 8. Special rules for river-side stands
1. This section applies to stands located beside the River San or any other flowing water.
2. The User acknowledges that the river level, current speed and condition of the bank may change rapidly, including as a result of rainfall outside the fishery premises.
3. It is prohibited to:
a) step onto exposed rocks, islands, sandbanks or shallows,
b) cross to the opposite bank,
c) wade in the river,
d) enter an undercut or eroding bank,
e) use a stand where the access route has been flooded,
f) remain at a stand after a hydrological warning has been issued or after being instructed to leave it.
4. If the water level begins to rise, the water becomes turbid, branches appear in the current or the access route becomes flooded, the User must leave the stand immediately and notify the Operator.
5. The User may not delay leaving the stand in order to secure equipment first. Protection of life and health takes priority.
§ 9. Rescue equipment and conduct in the event of an accident
1. Rescue equipment may be used only:
a) where life or health is at risk,
b) for exercises ordered by the Operator,
c) by rescue services.
2. Any person who notices an accident or a person in the water should, to the extent possible and without endangering their own life:
a) immediately call the emergency number 112,
b) notify the Operator on +48 888 999 111,
c) provide the stand number, the name of the fishery and the coordinates displayed on the information board,
d) throw the casualty a lifebuoy, rescue buoy or throw line,
e) follow the instructions of the emergency dispatcher.
3. A person without appropriate training should not enter the water to rescue another person if doing so could put their own life at risk.
4. It is prohibited to:
a) obstruct rescue equipment,
b) attach objects to it,
c) use a lifebuoy, rope, boat hook or throw line for play,
d) move the equipment without a justified need.
5. Any use of or damage to rescue equipment must be reported to the Operator immediately.
6. The User must report to the Operator every accident, fall into the water, injury, fainting episode or event that may be relevant to the safety of other persons.
7. The Operator may prepare records of an incident, including recording the details of participants and witnesses, taking photographs of the location and preserving CCTV recordings, in accordance with personal data protection laws.
§ 10. Angling rules
1. Angling may take place only in accordance with:
a) applicable law,
b) the permit issued by the entity entitled to conduct fisheries management,
c) fish conservation rules,
d) closed seasons and minimum legal sizes,
e) catch limits,
f) additional rules announced for the relevant fishery.
2. The use of fishing tools or methods prohibited by law or by the conditions of the permit is forbidden.
3. Caught fish must be handled in a manner that minimises their suffering and complies with the rules applicable at the fishery.
4. The “catch and release” rule applies at the fishery unless the rules for the relevant body of water, the permit or an express notice from the Operator allow specified fish to be taken.
5. Gutting or killing fish is permitted only at a designated place and only where the fishery rules expressly allow fish to be taken.
6. The User is responsible for complying with regulations governing angling and fish conservation.
7. One angler may use a maximum of 3 fishing rods at the same time, unless the permit, booking conditions or an Operator notice specifies a lower limit.
8. Groundbaiting is permitted only within the allocated sector and in an amount that does not pollute the water, impair its quality or interfere with the use of neighbouring stands. The Operator may temporarily restrict the type or amount of groundbait.
9. When angling for fish requiring particular protection, the User must use an appropriate unhooking mat or carp cradle, a landing net sized for the fish and a wound disinfectant. This equipment should be ready before angling begins.
10. A fish intended for release should remain out of the water for as short a time as possible. It must not be placed directly on the ground, gravel, a pier or any other hard surface.
§ 11. User liability
1. The User is liable for damage caused through their fault to the Operator, other Users or third parties.
2. The User is liable in particular for damage caused by:
a) a breach of the Regulations,
b) entering the water,
c) entering a closed area,
d) using a damaged or closed stand despite the relevant marking,
e) the use of alcohol or intoxicating substances,
f) failure to supervise a minor,
g) unauthorised interference with a pier, railing, bank or rescue equipment,
h) lighting a fire outside a designated place.
3. A breach of the safety rules by the User may be taken into account when assessing the User’s contribution to the occurrence or increase of damage, in accordance with applicable law.
4. The User is responsible for the conduct of minors and animals under their supervision.
§ 12. Operator liability
1. The Operator is liable for failure to perform or improper performance of its obligations and for damage caused through its fault, in accordance with applicable law.
2. The Operator does not exclude or limit liability for personal injury to the extent that such exclusion or limitation would be prohibited by law.
3. The Operator does not provide a storage service for the User’s equipment, vehicles, telephones, documents or other belongings unless it separately confirms that they have been accepted for safekeeping.
4. The User should protect their belongings against theft, precipitation, wind, flooding and damage.
5. The Operator is not liable for events resulting exclusively from:
a) conduct by the User contrary to the Regulations,
b) entering the water despite the prohibition,
c) entering an area excluded from use,
d) disregarding an evacuation instruction,
e) unauthorised use of watercraft,
f) the User’s concealment of circumstances preventing safe use, provided that the damage is not also connected with an act or omission for which the Operator is at fault.
6. No provision of the Regulations deprives a consumer of rights granted under mandatory provisions of law.
§ 13. Inspections and powers of the Operator
1. The Operator is entitled to inspect:
a) tickets and reservations,
b) permits and documents required for angling,
c) compliance with the Regulations,
d) the number of persons at a stand and compliance with the booking conditions.
2. Where there are reasonable grounds to suspect that a User is under the influence of alcohol or intoxicating substances, the Operator may refuse entry, order the User to stop using the fishery or call the competent services. Any voluntary test may be carried out only with the User’s consent.
3. The Operator may temporarily exclude a stand from use without prior notice where required for safety reasons.
4. In the event of a breach of the Regulations, the Operator may:
a) issue a warning,
b) order specified conduct or order angling to stop,
c) close a stand,
d) order a person to leave the premises,
e) call the Police, Fire Service, emergency medical services, the State Fisheries Guard or other competent services.
5. Removal of a User due to a serious or repeated breach of safety rules does not limit the User’s rights under consumer law. Settlement of the fee will take account of the circumstances of the incident and applicable law.
§ 14. Animals
1. An animal may be brought onto the premises only with the Operator’s consent or where the rules for the relevant stand expressly permit it.
2. The animal must remain under the constant control of its handler.
3. A dog should be kept on a lead and, where required by law, must also wear a muzzle.
4. An animal must not:
a) enter the water,
b) remain on a pier without the Operator’s consent,
c) interfere with angling,
d) pose a risk to people or other animals.
§ 15. Order and environmental protection
1. The User must leave the stand in no worse condition and free of waste.
2. Used fishing lines, hooks and other sharp items must be placed in the containers provided for that purpose.
3. It is prohibited to:
a) discharge substances into the water or soil,
b) discard excessive quantities of groundbait,
c) frighten or capture wild animals,
d) damage nests, burrows or habitats,
e) use chemicals that may contaminate the water.
§ 16. Reservations, payments, changes and additional services
1. A reservation requires the information specified in the booking system to be provided and acceptance of the Regulations, booking conditions, price list and information on personal data processing.
2. The agreement is concluded when the User receives a reservation confirmation from the Operator and the required advance payment is credited, unless the reservation confirmation expressly provides otherwise.
3. The advance payment is 30% of the total reservation price. The User must pay the remaining balance by the deadline indicated in the reservation confirmation, but no later than before use of the stand begins.
4. The User may change the booking date free of charge if the change is requested at least 7 days before the stay begins and the new date is available. If the change is requested 3 to 6 days before the stay begins, 50% of the advance payment is transferred to the new date. If the change is requested less than 72 hours before the stay begins, the advance payment is forfeited.
5. If the User cancels the booking: a) at least 7 days before the date - the date may be changed free of charge; b) 3 to 6 days before the date - 50% of the advance payment is transferred to a new date; c) less than 72 hours before the date - the advance payment is forfeited, subject to mandatory provisions of law.
6. Failure by the User to attend without prior cancellation is treated as withdrawal from the service. The advance payment is then non-refundable and the Operator may make the stand available to other Users.
7. The User’s late arrival does not extend the reserved session or reduce the price. Voluntarily leaving the stand early does not provide grounds for a refund for unused time unless the reason was improper performance of the service by the Operator.
8. If the Operator closes the fishery or a stand before use begins or during use due to a thunderstorm, high water, infrastructure damage or another hazard, the User may choose a change of date or a refund of the appropriate part of the price paid for the unused service. This provision does not limit the consumer’s statutory rights.
9. A refundable deposit of PLN 200 is charged for the fish safety kit made available to the User. The deposit is refunded after the complete and undamaged kit is returned on time. The Operator may deduct from the deposit only the documented cost of missing or damaged items, taking normal wear and tear into account.
10. The basic reservation covers the number of persons and anglers stated in the confirmation. Participation by a third angler requires the Operator’s prior consent, availability of the stand and payment of the fee specified in the current price list.
11. Arrival in a motorhome or with a caravan, parking an additional car and using an electrical power connection require prior notification and express confirmation by the Operator. Availability of these services depends on the stand, technical and safety conditions, and may be subject to an additional fee in accordance with the price list.
12. Additional services and equipment are included in the reservation only if they are stated in the confirmation. Absence of prior confirmation does not guarantee their availability on site.
§ 17. Complaints
1. Complaints may be submitted:
a) in writing to the Operator’s address,
b) electronically to info@siedliska11.pl,
c) in person at the fishery service point.
2. A complaint should include contact details, a description of the event and the User’s request.
3. The Operator will consider the complaint within the period prescribed by applicable law.
4. Reporting an accident may not be made conditional on compliance with a particular form or on excessively burdensome formalities.
§ 18. Personal data and CCTV monitoring
1. Information about the personal data controller, the purposes and legal grounds for processing and the rights of data subjects is provided in a separate privacy notice.
2. The fishery premises may be covered by CCTV monitoring to protect life, health and property and to document incidents, provided that the monitored area is properly marked.
3. Monitoring does not cover places where a User may reasonably expect a particular degree of privacy.
§ 19. Final provisions
1. Matters not governed by the Regulations are subject to applicable law.
2. Disputes will be resolved by the court having jurisdiction in accordance with applicable law.
3. An amendment to the Regulations does not prejudice rights acquired by Users before the amendment takes effect.
4. The Operator may issue temporary safety notices and instructions arising from current weather, water conditions or the condition of the infrastructure.
5. Safety notices take precedence over the general rules of use, but may not limit the User’s rights arising under mandatory provisions of law.
6. Version 1.0 of the Regulations is effective from 01.08.2026.
7. The following form an integral part of the Regulations:
a) fishery plan and arrangement of stands - Fishery map
b) list of rescue equipment points and emergency procedure - Safety
c) angling rules and limits applicable to the relevant body of water - Angling regulations
d) price list - Price list
e) booking conditions - Reservations
f) personal data privacy notice - Privacy policy
The acknowledgement is signed at the time of the first reservation. The Operator may request a new acknowledgement following a material amendment to the Regulations, the safety rules or the conditions of use of a particular stand.
